Gostujoče predavanje prof. dr. Christiana Bellaka glede bilateralnih investicijskih pogodb

22. maja 2024 se je odvilo gostujoče predavanje prof. dr. Christiana Bellaka na temo bilateralnih investicijskih pogodb s poudarkom na Braziliji in Kitahsju. Izsledki predavanja so na voljo v nadaljevanju v angleškem jeziku.

In his lecture titled “Do BITs bite?” he highlighted fresh evidence from two policy reforms and  worries of policy makers that their benefits (impact on FDI) do not outweigh their costs (restricted policy space due to Investor-State Dispute Settlement). The lecture showed that two policy reforms, one from Brazil and one from China, showed different results. Brazil recently introduced a novel type of BITs which explicitly exclude provisions for Investor-State Dispute Settlement and their analysis showed that these new BITs are not able to spur Brazilian FDI. In contrast, China made its BITs much more investor-friendly by including far-reaching provisions for Investor-State Dispute Settlement and the analysis showed that these new BITs attract FDI to China. These results are consistent with the view that BITs bite, i.e., they attract and spur FDI, in case they include provisions for Investor-State Dispute Settlement.
